Release of Liability, Waiver of Claims, Assumption of Risk and Indemnity Agreement
This agreement is between the participant (and, for a minor, the participant's parent or legal guardian) and Academy Simulation LLC, which operates the dry-fire laser training lanes located inside the Academy Sim Racing lounge at 1421 Massaro Blvd, Tampa, Florida 33619.
"Released Parties" means Academy Simulation LLC and Academy Sim Racing, their parent company, affiliates, owners, members, managers, officers, employees, staff, contractors, agents, successors and assigns, and the owner and landlord of the premises.
1. The activity
The activity is dry-fire marksmanship training using inert laser training pistols (including the Mantis TitanX) that emit a brief visible laser pulse, smart targets, phones or tablets running training apps, holsters, magazines and related equipment, plus any demonstration, instruction, practice, competition, leaderboard or retail product trial at the station (the "Activity"). No firearms or ammunition are used or allowed.
2. Known risks
I understand the Activity has risks that cannot be fully eliminated, including but not limited to:
- Laser exposure. The training pistols use a Class 3R laser. Looking into the beam or having it pointed at the eyes can cause eye injury, including permanent vision damage.
- Physical activity. Drawing, moving, kneeling, reloading and standing for extended periods can cause strains, sprains, falls, cuts, pinches and other injuries.
- Equipment. Equipment can fail, malfunction, be dropped or be used incorrectly by me or others.
- Replica appearance. The training pistols look like real firearms. Handling or displaying them outside the lane could cause alarm or a response from others, including law enforcement.
- Other people. Other participants, spectators or staff may act carelessly.
- Medical conditions. Existing medical conditions, including light or photosensitivity conditions, may be worsened.
3. Rules I agree to follow
- I will not bring any firearm, ammunition or weapon into the station or the building.
- I will point training pistols only downrange at the targets and never at any person, animal, window or reflective surface.
- I will never look into the laser emitter or point it at anyone's eyes.
- Training pistols stay at the lane. I will not remove them from the station or take them outside.
- I will follow all posted rules and every instruction from staff. Staff may end my session at any time without refund if I break the rules.
- I will not participate under the influence of alcohol, drugs or any substance that impairs judgment.
- I will pay for any equipment I damage through misuse.
4. Assumption of risk
I am participating voluntarily. I knowingly and freely assume all risks of the Activity, both known and unknown, even if they arise from the negligence of the Released Parties, to the fullest extent allowed by Florida law.
5. Release and waiver
In exchange for being allowed to participate, I release, waive, discharge and agree not to sue the Released Parties for any and all claims, demands, losses or damages for injury, illness, death or property damage arising out of or related to the Activity, including claims caused by the ordinary negligence of the Released Parties, to the fullest extent allowed by law. This release does not apply to gross negligence or intentional misconduct.
6. Indemnity
I agree to indemnify and hold harmless the Released Parties from any claim, loss, liability, cost or attorney's fees arising from my participation, my breach of this agreement, or my actions toward any other person.
7. Medical treatment
I authorize the Released Parties to obtain emergency medical treatment for me (or the minor I sign for) if needed, and I agree to pay for any such treatment.
8. Photos and video
If I check the photo/video consent box below, I allow Academy Simulation LLC and Academy Sim Racing to use photos, video and leaderboard names captured at the station for marketing, without payment. If I do not check the box, no images of me will be used.
9. Minors
Participants ages 12–17 may take part only with a parent or legal guardian who signs this agreement and stays at the station for the entire session. Under 12 may not participate. A parent or guardian signing for a minor agrees to this entire agreement on the minor's behalf and on their own behalf, and confirms they have legal authority to sign.
NOTICE TO THE MINOR CHILD'S NATURAL GUARDIAN
READ THIS FORM COMPLETELY AND CAREFULLY. YOU ARE AGREEING TO LET YOUR MINOR CHILD ENGAGE IN A POTENTIALLY DANGEROUS ACTIVITY. YOU ARE AGREEING THAT, EVEN IF ACADEMY SIMULATION LLC AND ACADEMY SIM RACING USE REASONABLE CARE IN PROVIDING THIS ACTIVITY, THERE IS A CHANCE YOUR CHILD MAY BE SERIOUSLY INJURED OR KILLED BY PARTICIPATING IN THIS ACTIVITY BECAUSE THERE ARE CERTAIN DANGERS INHERENT IN THE ACTIVITY WHICH CANNOT BE AVOIDED OR ELIMINATED. BY SIGNING THIS FORM YOU ARE GIVING UP YOUR CHILD'S RIGHT AND YOUR RIGHT TO RECOVER FROM ACADEMY SIMULATION LLC AND ACADEMY SIM RACING IN A LAWSUIT FOR ANY PERSONAL INJURY, INCLUDING DEATH, TO YOUR CHILD OR ANY PROPERTY DAMAGE THAT RESULTS FROM THE RISKS THAT ARE A NATURAL PART OF THE ACTIVITY. YOU HAVE THE RIGHT TO REFUSE TO SIGN THIS FORM, AND ACADEMY SIMULATION LLC AND ACADEMY SIM RACING HAVE THE RIGHT TO REFUSE TO LET YOUR CHILD PARTICIPATE IF YOU DO NOT SIGN THIS FORM.
10. Term
This agreement covers every dry-fire session I (or the minor I sign for) take part in for 12 months from the date signed.
11. General
This agreement is governed by Florida law, with venue in Hillsborough County, Florida. If any part is found unenforceable, the rest remains in effect. This is the entire agreement on this subject.
12. Electronic signature
I agree that my typed name and drawn signature below are my legal signature, with the same effect as a handwritten signature, under the federal E-SIGN Act and Florida's Uniform Electronic Transaction Act.
I HAVE READ THIS AGREEMENT, UNDERSTAND IT, AND SIGN IT VOLUNTARILY. I UNDERSTAND I AM GIVING UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE.
